What does a peaceful assembly mean?

The right to freedom of peaceful assembly is one of the fundamental human rights  which allows citizens to publicly express their opinion and attitude towards actions or lack of actions of authorities, governmental and non-governmental organizations by using mass media for informing and mobilizing like-minded persons, as well as initiating public discussions of topical social issues.

 

The right to freedom of peaceful assembly is a feature of a democratic society and a tool that allows influencing state policy and expressing own views and positions.

The right to freedom of peaceful assembly has been fought for during a long period of time, and it is reflected in fundamental instruments of national and international law.

 

Provisions relating to freedom of peaceful assembly have been codified and guaranteed by international legal instruments, including the Universal Declaration of Human Rights, International Covenant on Civil and Political Rights, Convention for the Protection of Human Rights and Fundamental Freedoms, etc.

 

Fulfillment of the right to freedom of peaceful assembly and action against its illegal restriction have repeatedly played a decisive role in the history of independent Ukraine.

The right to freedom of peaceful assembly is ensured by Article 39 of the Constitution of Ukraine which guarantees that citizens have the right to assemble peacefully, without weapons and conduct gatherings, rallies, marches, and demonstrations, about the conduct of which executive bodies or local self-government bodies are notified in advance.

The right to freedom of peaceful assembly is not absolute and may be subject to restrictions, but such restrictions shall always comply with high standards of reasonableness and proportionality.
